沅陵縣(xian)進一(yi)步推動(dong)“執照剝離”改善運作預案

為(wei)深入貫徹落實(shi)《國務院關(guan)于(yu)深化(hua)“證(zheng)照分離(li)”改革(ge)(ge)進一步(bu)激(ji)發(fa)(fa)(fa)市場主(zhu)體(ti)(ti)發(fa)(fa)(fa)展活力的(de)通知》(國發(fa)(fa)(fa)〔2021〕7號)、《湖南(nan)省人民政府辦(ban)公廳關(guan)于(yu)印發(fa)(fa)(fa)〈湖南(nan)省深化(hua)“證(zheng)照分離(li)”改革(ge)(ge)實(shi)施方(fang)(fang)案(an)〉的(de)通知》(湘政辦(ban)發(fa)(fa)(fa)〔202𒁏1〕45號)等(deng)文件(jian)要求,持續深化(hua)“放管(guan)服”改革(ge)(ge)優(you)化(hua)營商環境,進一步(bu)激(ji)發(fa)(fa)(fa)市場主(zhu)體(ti)(ti)發(fa)(fa)(fa)展活力,在全縣(xian)范圍內推行“證(zheng)照分離(li)”改革(ge)(ge)全覆蓋,結(jie)合我縣(xian)實(shi)際(ji),制定(ding)本方(fang)(fang)案(an)。

一、整體請求

(一)指引心理。以施芝鴻新(xin)(xin)世紀全國地方特色社會(hui)(hui)各(ge)界實(shi)用(yong)主義(yi)思路為免費指導,切實(shi)貫(guan)徹執行黨(dang)的(de)十(shi)八大和(he)(he)十(shi)八屆(jie)二(er)中(zhong)(zhong)(zhong)(zhong)、二(er)中(zhong)(zhong)(zhong)(zhong)、四中(zhong)(zhong)(zhong)(zhong)、五中(zhong)(zhong)(zhong)(zhong)黨(dang)代(dai)會(hui)(hui)信念(nian),根據(ju)黨(dang)中(zhong)(zhong)(zhong)(zhong)、國內決(jue)策者召開會(hui)(hui)議和(he)(he)省(sheng)委辦公(gong)(gong)廳(ting)省(sheng)縣人民政(zheng)府(fu)辦公(gong)(gong)室(shi)、市(shi)委市(shi)政(zheng)公(gong)(gong)用(yong)工程(cheng)(cheng)(cheng)府(fu)辦公(gong)(gong)室(shi)、縣委縣縣人民政(zheng)府(fu)辦公(gong)(gong)室(shi)工作上請求,做好技術創(chuang)新(xin)(xin)程(cheng)(cheng)(cheng)序智能家居控制、協同工作更高效,持續保持持續深入(ru)推進“放(fang)管服”技術創(chuang)新(xin)(xin),統籌規劃深入(ru)推進行政(zheng)處審批流(liu)程(cheng)(cheng)(cheng)流(liu)程(cheng)(cheng)(cheng)管理機制技術創(chuang)新(xin)(xin)和(he)(he)民商事管理機制技術創(chuang)新(xin)(xin),在越(yue)(yue)多(duo)范疇和(he)(he)越(yue)(yue)多(duo)行業內持續推進照后𓄧(hou)減證和(he)(he)抽象化審批流(liu)程(cheng)(cheng)(cheng)流(liu)程(cheng)(cheng)(cheng),技術創(chuang)新(xin)(xin)和(he)(he)做好事中(zhong)(zhong)(zhong)(zhong)案后(hou)監察,創(chuang)設(she)比(bi)較穩定、公(gong)(gong)道、透明體(ti)、可預期收益的(de)的(de)市(shi)場審批的(de)環境,力(li)助我(wo)區(qu)劃算優重量發展(zhan)。

(二)制度改革最終目標。在全區範(fan)圍內堅持(chi)(chi)制(zhi)定一個涉企(含個體戶(hu)工(gong)商行戶(hu)、農民(min)工(gong)專業(ye)(ye)課(ke)程公(gong)司農業(ye)(ye)合作社,下求)營運許可(ke)證地方(fang)全履蓋明細管理制(zhi)度,采用(yong)會撤除申批、申批轉換成備案流程、設立通知承諾卡、seo審(shen)批制(zhi)權服務性等四大途徑總類發展審(shen)批制(zhi)權制(zhi)度管理體制(zhi)改革,努力實現(🌌xian)20222019年(nian)的時候(hou)前保持(chi)(chi)極簡風格高、公(gong)平公(gong)正(zheng)無色、寬進嚴管的互聯網行業(ye)(ye)準營玩法,幅寬上增長賣場主(zhu)體結構辦事(shi)人的便民(min)度和可(ke)期望值性。

二(er)、力抓推(tui)進照后減證和還簡化備(bei)案(an)

法律(lv)、行政(zhengℱ)法規、國(guo)務(wu)院決定(ding)(ding)(ding)設(she)定(ding)(ding)(ding)(以下統(tong)稱中(zhong)央層面設(she)定(ding)(ding)(ding))的(de)(de)涉(she)企經(jing)營許(xu)可(ke)(ke)事(shi)項(xiang)(xiang),按(an)照《2021年湖南版中(zhong)央層面設(she)定(ding)(ding)(ding)的(de)(de)涉(she)企經(jing)營許(xu)可(ke)(ke)事(shi)項(xiang)(xiang)改(gai)(gai)革(ge)(ge)(ge)清(qing)單(縣級(ji)改(gai)(gai)革(ge)(ge)(ge)事(shi)項(xiang)(xiℱang))》(見(jian)(jian)附件1),在全縣范圍內分類(lei)實施(shi)改(gai)(gai)革(ge)(ge)(ge)。地(di)方(fang)層面設(she)定(ding)(ding)(ding)的(de)(de)涉(she)企經(jing)營許(xu)可(ke)(ke)事(shi)項(xiang)(xiang),按(an)照《2021年版地(di)方(fang)層面設(she)定(ding)(ding)(ding)的(de)(de)涉(she)企經(jing)營許(xu)可(ke)(ke)事(shi)項(xiang)(xiang)改(gai)(gai)革(ge)(ge)(ge)清(qing)單(縣級(ji)改(gai)(gai)革(ge)(ge)(ge)事(shi)項(xiang)(xiang))》(見(jian)(jian)附件2)執行。

(一)可以撤銷了貸款審核。對“典當業(ye)(ye)特(te)種行業(ye)(ye)許(xu)(xu)可(ke)(ke)證(zheng)核發”等(denᩚᩚᩚᩚᩚᩚ⁤⁤⁤⁤ᩚ⁤⁤⁤⁤ᩚ⁤⁤⁤⁤ᩚ𒀱ᩚᩚᩚg)(deng)審批層級為(wei)縣級的(de)8項(xiang)涉(she)企(qi)經營(ying)許(xu)(xu)可(ke)(ke)事項(xiang)直(zhi)接取消審批,行政審批部門(men)一(yi)律不(bu)再受理相(xiang)關(guan)事項(xiang),不(bu)得(de)以拆分、合并或(huo)重組等(deng)(deng)名義,條(tiao)目變(bian)相(xiang)審批,不(bu)得(de)轉(zhuan)移至行業(ye)(ye)協會、社會組織變(bian)相(xiang)ꦜ保留,企(qi)業(ye)(ye)取得(de)營(ying)業(ye)(ye)執(zhi)照即(ji)可(ke)(ke)開展經營(ying),行政機關(guan)、企(qi)事業(ye)(ye)單(dan)(dan)位、行業(ye)(ye)組織等(deng)(deng)不(bu)得(de)要求企(qi)業(ye)(ye)提供(gong)相(xiang)關(guan)行政許(xu)(xu)可(ke)(ke)證(zheng)件(jian)。在政府采購中,不(bu)得(de)將企(qi)業(ye)(ye)取得(de)或(huo)曾經取得(de)相(xiang)關(guan)許(xu)(xu)可(ke)(ke)證(zheng)作為(wei)必(bi)要條(tiao)件(jian)或(huo)評分事項(xiang)。(縣直(zhi)有關(guan)單(dan)(dan)位負(fu)責)

(二)審批制變成登記。對“機動(dong)車駕駛員培訓許可(ke)”等(deng)審批(pi)層級為縣(xian)級的(de)5項(xiang)(xiang)涉企(qi)經營(ying)許可(ke)事項(xiang)(xiang)改(gai)為備(bei)(bei)(bei)案(an)管(guan)理。審批(pi)改(gai)為備(bei)(bei)(bei)案(an)后,原則上實行事后備(bei)(bei)(bei)案(an),企(qi)業取(qu)得營(ying)業執(zhi)照即可(ke)開展經營(ying);確(que)需(xu)事前備(bei)(bei)(bei)案(an)的(de),企(qi)業完成備(bei)(bei)(bei)案(an)手續(xu)即可(ke)開展經營🅘(ying)。有關主(zhu)管(guan)部門要抓緊(jin)建立健(jian)全備(bei)(bei)(bei)案(an)制度,公布辦(ban)理備(bei)(bei)(bei)案(an)事項(xiang)(xiang)所需(xu)的(de)材(cai)料,企(qi)業按規定(ding)提交備(bei)(bei)(bei)案(an)材(cai)料的(de),有關主(zhu)管(guan)部門應(ying)🌄當當場辦(ban)理備(bei)(bei)(bei)案(an)手續(xu),不(bu)得作出不(bu)予備(bei)(bei)(bei)案(an)的(de)決定(ding)。(縣(xian)直有關單位負(fu)責)

(三)施行告知書模板承諾函。對“旅館業🅰(ye)特種行(xing)業(ye)許(xu)可證核(he)發”等審(shen)批層(ceng)級為縣級的29項(xiang)涉企經營許(xu)可事項(xiang)實行(xing)告(gao)知(zhi)承(cheng)諾。實行(xing)告(gao)知(zhi)承(cheng)諾,有(you)關主(zhu)管部(bu)門(men)要(yao)嚴格按照《湖南(nan)省人民政府辦公(gong)廳關于印發(fa)<湖南(nan)省全面推行涉企(qi)(qi)(qi)(qi)(qi)(qi)(ꦅqi)經營(ying)許(xu)(xu)可(ke)(ke)事項(xiang)告(gao)知承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)制實施方案>的(de)通(tong)知》(湘政辦發(fa)〔2021〕25號)要(yao)求(qiu)(qiu),科學編制告(gao)知承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)制工作規(gui)程,依法列出可(ke)(ke)量化、可(ke)(ke)操作,不含模糊表(biao)述和兜(dou)底條(tiao)款(kuan)的(de)經營(ying)許(xu)(xu)可(ke)(ke)條(tiao)件,明確監管規(gui)則(ze)和違反(fan)承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)后果,一(yi)次性告(gao)知企(qi)(qi)(qi)(qi)(qi)(qi)(qi)業,并提(ti)供告(gao)知承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)示范文本(ben)。對因企(qi)(qi)(qi)(qi)(qi)(qi)(qi)業承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)可(ke)(ke)以(yi)減省的(de)審批(pi)材料(liao),不再(zai)要(yao)求(qiu)(qiu)企(qi)(qi)(qi)(qi)(qi)(qi)(qi)業提(ti)供;對可(ke)(ke)在企(qi)(qi)(qi)(qi)(qi)(qi)(qi)業領證后補交(jiao)的(de)審批(pi)材料(liao),實行容缺辦理、限(xian)期補交(jiao)。對企(qi)(qi)(qi)(qi)(qi)(qi)(qi)業自(zi)愿作出承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)并按要(yao)求(qiu)(qiu)提(ti)交(jiao)材料(liao)的(de),要(yao)當(dang)場(chang)作出審批(pi)決定。針對實行告(gao)知承(cheng)(cheng)(cheng)(cheng)諾(nuo)(nuo)(nuo)制的(de)涉企(qi)(qi)(qi)(qi)(qi)(qi)(qi)經營(ying)許(xu)(xu)可(ke)(ke)事項(xiang)清單,分(fen)類確定核查(cha)時間(jian)、標(biao)準、方法以(yi)及(ji)是否免于核查(cha)。(縣直(zhi)有(you)關單位負責)

(四)SEO優化審查業務。對“勞務(wu)(wu)(wu)派遣經營(ying)許(xu)可”等(deng)審(shen)批(pi)(pi)(pi)(pi)層(ceng)(ceng)級(ji)(ji)為縣級(ji)(ji)以及改(gai)革后審(shen)批(pi)(pi)(pi)(pi)層(ceng)(ceng)級(ji)(ji)下放(fang)至縣級(ji)(ji)的(de)(de)36項(xiang)涉(she)企經營(ying)許(xu)可事項(xiang)實(shi)行優(you)化(hua)(hua)審(shen)批(pi)(pi)(pi)(pi)服(fu)(fu)務(wu)(wu)(wu)。對直(zhi)接取(qu)消(xiao)審(shen)批(pi)(pi)(pi)(pi)、審(shen)批(pi)(pi)(pi)(pi)改(gai)為備案、實(shi)行告知承(cheng)諾(nuo)以外的(de)(de)其(qi)他涉(she)企經營(ying)許(xu)可事項(xiang),有關主管部門要按照(zhao)“一(yi)件(jian)事一(yi)次辦”改(gai)革要求,綜合運用(yong)下放(fang)審(shen)批(pi)(pi)(pi)(pi)權限、精簡許(xu)可條件(jian)、簡化(hua)(hua)審(shen)批(pi)(pi)(pi)(pi)材料、優(you)化(hua)(hua)審(shen)批(pi)(pi)(pi)(pi)流程、壓縮審(she🧸n)批(pi)(pi)(pi)(pi)時間、延長或取(qu)消(xiao)許(xu)可期限,以及取(qu)消(xiao)或放(fang)寬審(shen)批(pi)(pi)(pi)(pi)數量限制(zhi)并定期公(gong)布總量控(kong)🌃制(zhi)條件(jian)、企業(ye)存量、申(shen)請(qing)排序(xu)情況(kuang)等(deng)方式,進一(yi)步優(you)化(hua)(hua)審(shen)批(pi)(pi)(pi)(pi)服(fu)(fu)務(wu)(wu)(wu),提高審(shen)批(pi)(pi)(pi)(pi)效率,鼓勵企業(ye)有序(xu)競(jing)爭。(縣直(zhi)有關單位負責)

三、強化木(mu)紋(wen)地板改(gai)革創新系統性iꦕbms和(he)協同管理配套方案(an)

(一)采取涉企營業許可證相關事宜通知單菅理。按照(zhao)“證照(zhao)分(fen)離”改革全(quanꦍ)覆蓋工作要(yao)求(qiu),將審批層(ceng)級為(wei)縣(xian)級的中央和地方(fang)層(ceng)面設定的涉企(qi)經(jing)營(ying)(ying)許可事項(xiang)全(quan)部(bu)納(na)入我縣(xian)涉企(qi)經(jing)營(ying)(ying)許可事項(xiang)清(qing)單(dan)(dan),縣(xian)審改辦要(yao)建立健全(quan)清(qing)單(dan)(dan)管理制度(du),動(dong)態調整更新清(qing)單(dan)(dan),及(ji)時(shi)通過縣(xian)政(zheng)府門戶網站和一體化政(zheng)務服務平臺向社(she)會(hui)公(gong)布(bu),接受社(she)會(hui)監督。縣(xian)直各有關(guan)部(bu)門要(yao)逐(zhu)項(xiang)認領和嚴(yan)格執(zhi)行清(qing)單(dan)(dan)中的事項(xiang),2021年年底前對清(qing)單(dan)(dan)之(zhi)外(wai)限(xian)制企(qi)業進入特定行業開展(zhan)經(jing)營(ying)(ying)的管理事項(xiang)進行全(quan)面自查清(qing)理。清(qing)單(dan)(d🗹an)之(zhi)外(wai),一律不得限(xian)制企(qi)業進入相關(guan)行業開展(zhan)經(jing)營(ying)(ying)。(縣(xian)政(zheng)務中心、縣(xian)市場監管局牽頭,縣(xian)直有關(guan)單(dan)(dan)位負(fu)責)

(三)推動自動化執照歸集靈活運用。落實(shi)國務(wu)院(yuan)關于電(dian)子(zi)(zi)證照(zhao)標準、規范和樣式的有(you)關要求,及時將電(dian)子(zi)(zi)證照(zhao)歸(gui)集至(zhi)全(quan)國一(yi)(yi)體(ti)化政(zheng)(zheng)務(wu)服(fu)(fu)務(wu)平(ping)臺、全(quan)國信用(yong)信息共享平(ping)臺、國家企(qi)業信用(yong)信息公(gong)示系(xi)統(tong),同(tong)步歸(gui)集至(zhi)湖(hu)南省(sheng)“互(hu)聯(lian)網+政(zheng)(zheng)務(wu)服(fu)(fu)務(wu)”一(yi)(yi)體(ti)化平(ping)臺,在2022年底前全(quan)面實(shi)現(xian)涉企(qi)證照(zhao)電(dian)子(zi)(zi)化。依托全(quan)國統(tong)一(yi)(yi)、實(shi)時更新、權威可靠的企(qi)業電(dian)子(zi)(zi)證照(zhao)庫,實(shi)現(xian)涉企(qi)電(dian)子(zi)(zi)證照(zhao)、電(dian)子(zi)(zi)認(ren)證、電(dian)子(zi)(zi)印(yin)章(zhang)(zhang)聯(lian)動(dong)(dong)應用(yong),實(shi)現(xian)電(dian)子(zi)(zi)證照(zhao)、電(dian)子(zi)(zi)印(yin)章(zhang)(z♍hang)信息跨(kua)層級(ji)、跨(kua)地域、跨(kua)部門共享及互(hu)認(ren)互✨(hu)信,在政(zheng)(zheng)務(wu)服(fu)(fu)務(wu)、商(shang)業活(huo)動(dong)(dong)等場景(jing)大力拓展企(qi)業電(dian)子(zi)(zi)營業執照(zhao)、電(dian)子(zi)(zi)印(yin)章(zhang)(zhang)應用(yong),逐步減少(shao)企(qi)業紙質執照(zhao)和實(shi)體(ti)印(yin)章(zhang)(zhang)使(shi)用(yong)需求。(縣政(zheng)(zheng)務(wu)服(fu)(fu)務(wu)中心、縣市場監管(guan)局(ju)、縣發改(gai)局(ju)牽(qian)頭,縣直有(you)關單位負責)

四、服務的具體措施
